The images on this website are works of authorship: viewing them is free, reproducing them is not.
Article 1 — Purpose and acceptance
These terms of use set out the conditions for accessing and using the website. Browsing the website constitutes acceptance of these terms in the version in force on the date of the visit. The publisher may amend them at any time; the applicable version is the one published online, whose last update date appears at the bottom of this document.
Article 2 — Intellectual property and copyright
All elements of this website — structure, layout, texts, photographs, captions, titles of works and series, logos and trademarks — are protected by the French Intellectual Property Code and by international conventions, and remain the exclusive property of EI Denis Morel or its rights holders.
No reproduction. Any reproduction, performance, distribution, modification, adaptation, translation or making available to the public, in whole or in part, of these elements, on any medium and by any means, is prohibited without the publisher’s prior written consent (articles L.122-4 and L.122-5 of the French Intellectual Property Code). This includes in particular downloading, screen capture for distribution, automated scraping of the website and the use of images to train artificial intelligence systems; the publisher expressly exercises the opt-out provided for in article L.122-5-3 of the same code.
Derivative works. Any alteration of an image — cropping, retouching, colourisation, inclusion in a composition, computer-assisted generation based on the work — constitutes a derivative work within the meaning of article L.112-3 of the French Intellectual Property Code. The author of such a work may not disclose, exploit or assign it without the prior consent of the author of the original work, in accordance with article L.113-4.
Moral rights. The right to respect for the author’s name, status and the integrity of the work is attached to the author personally; it is perpetual, inalienable and imprescriptible (article L.121-1). No transfer of a file or print entails the transfer of moral rights or reproduction rights.
Commissioned photographs. Photographs taken for clients are published with their consent. Their presence on this website grants no rights whatsoever to visitors. People and companies depicted may request the removal of an image by writing to contact@denis-morel.com.
Commercial and advertising use. No photograph may be used for commercial, advertising, promotional or editorial purposes without a written contract specifying the scope, duration, territory and media of the licence granted.
Penalties. Any infringement of the above rights constitutes the offence of counterfeiting under French law, punishable by three years’ imprisonment and a €300,000 fine (article L.335-2 of the French Intellectual Property Code), without prejudice to any damages that may be claimed.
Permission to use an image may be requested at contact@denis-morel.com. Requests for educational, non-profit or journalistic use are considered favourably.
Article 3 — Hyperlinks
Outbound links. The website may link to third-party websites whose content and availability the publisher does not control. The publisher accepts no liability for such content.
Inbound links. Linking to a publicly accessible page of the website does not require permission. The publisher would nevertheless be grateful to be informed at contact@denis-morel.com, and asks that the link open the page in a separate window, clearly state the source, and cause no confusion as to the origin of the content. The publisher reserves the right to request the removal of a link from a website publishing unlawful, hateful, defamatory or pornographic content, or whose association would harm its reputation.
Displaying an image through an embedded frame (“framing”), transclusion or a direct deep link to an image file is, however, treated as an act of reproduction and falls under article 2 above.
Article 4 — Personal data
The data controller is EI Denis Morel, 1 rue Charles Testoud, 38000 Grenoble, France — contact@denis-morel.com. No data protection officer has been appointed, as the business is not required to do so.
Processing carried out. This website has no form, no member area and no audience measurement tool. The only data received is what you choose to send by email or phone (surname, first name, email address, phone number, message) — purpose: to answer your enquiry and, where applicable, to prepare a quote. Legal basis: the publisher’s legitimate interest in handling enquiries addressed to it (article 6.1.f of the GDPR). Retention: 3 years from the last contact.
Recipients and processors. Data is processed by the publisher alone and by strictly necessary technical providers: OVH SAS for hosting and email, with data stored in the European Union. No data is sold, rented or transferred to third parties for commercial purposes.
Transfers outside the European Union. No data is transferred outside the European Union.
Your rights. You have the right to access, rectify and erase your data, to restrict or object to its processing, and to data portability. These rights can be exercised by email at contact@denis-morel.com or by post to the registered office, together with any information allowing your identity to be verified. You will receive a reply within one month. If you are not satisfied with the reply, you may lodge a complaint with the French data protection authority (CNIL) — 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France, www.cnil.fr.
No automated decision-making. No automated decision-making or profiling is carried out.
Article 5 — Cookies and trackers
This website sets no cookies or trackers: no advertising cookies, no social media trackers, no audience measurement and no cross-site tracking. No consent is therefore requested.
Article 6 — Liability and availability
The publisher takes the greatest care over the accuracy of the information published, but cannot guarantee that it is free of errors or omissions. Information is provided for guidance only and is not contractually binding; only an accepted quote is binding.
The publisher endeavours to keep the website available at all times, without being bound to do so: access may be interrupted for maintenance or updates, or due to external circumstances, including network or hosting failures. No compensation may be claimed on this basis.
The colours of images displayed on screen depend on your device’s display and calibration. These limitations do not apply in the event of gross negligence or wilful misconduct by the publisher, nor to personal injury.
Article 7 — Governing law and jurisdiction
These terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution. Failing that, the dispute will be brought before the courts of Grenoble, subject to mandatory legal provisions protecting consumers: consumers retain the right, under article R.212-2 of the French Consumer Code and articles 17 to 19 of Regulation (EU) No 1215/2012, to bring proceedings before the courts of their place of residence or of the place where the service was performed.
